II. PURPOSE AND SCOPE

The purpose of this analysis is to demonstrate the methodology used to trace and allocate marital and separate property interests in the Sample 401(k) Plan. This sample report illustrates the forensic tracing process used in ForensicCalc to classify and allocate property in dissolution of marriage proceedings.

The scope of this sample analysis includes:

  • Review of account statements spanning the period from June 15, 2010 through March 1, 2024
  • Identification of pre-marital separate property of $45,000
  • Tracing of marital contributions, employer matching contributions, and investment growth
  • Pro-rata allocation of gains, losses, fees, and withdrawals between separate and marital components
  • Calculation of final separate and marital property interests as of March 1, 2024

This report applies generally accepted forensic accounting principles and methodologies commonly used in family law matters. The allocation method used is the "pro-rata" or "percentage" approach, which allocates growth and activity based on the relative proportions of separate and marital property.
